On Tuesday, Janel Grant's lawyers filed a petition for pre-action discovery against Dr. Carlon Colker and Peak Wellness, Inc., located in Connecticut. They are seeking testimony and records in relation to her litigation against Vince McMahon, John Laurinaitis, and WWE. The filing states that along with being a "celebrity doctor", he is the go-to doctor for WWE talent and employees.

According to the filing, Colker treated Grant for fatigue and insomnia at the behest of McMahon in 2019. Over the next 28 months, Colker and anoher practioner a Peak Welless continued to see her at McMahon's direction. She was treated on more than 60 occassions. On these visits, she was given "supplement trays" and ordered to take them daily.

She was also given "unidtentified weekly transfusions". When Grant asked what the supplements and infusions were, Colker "continually refuse to explain the purpose or nature of the pills, stating: 'If you don’t trust me, we have bigger problems.'" Grant reported to Colker that she didn't feel well when receiving the IV drips and he told her it was because of her personal "tolerance".

Over the course of her visits, Grant was only provided with incomplete and innaccurate paper records and was not allowed to access her digital medical records. The filing states that McMahon had control over her life, including medical decisions. He and/or WWE paid for her visits to Peak Wellness, totalling over $51,000. Grant never received or paid invoices from Peak Wellness, according to the filing. When Grant refused to provide a credit card to pay for services, Colker berated her and asked "is there was a problem with money? Is this aboout the NDA?"

The filing also states that Colker had " personal knowledge of the circumstances surrounding a purported non-disclosure agreement at issue in the Federal Action." McMahon had given Grant permission to ask for an attorney referral. "Dr. Colker recommended Defendants' attorney to Ms. Grant and upon McMahon's approval, Ms. Grant engaged that attorney to represent her in the negotiation of the purported non-disclosure agreement."

The alleged control McMahon exerted over all aspects of Grant's life extended to McMahon and a Peak Wellness employee having "involvement in several instances of sexual abuse against Ms. Grant". In her initial lawsuit, Grant says she was forced into a threesome with McMahon and the employee. This is not to be confused with the threesome that McMahon and Laurinaitis forced her into also mentioned in the lawsuit.

The filing was made for the testimony and records because they are “material and necessary to determine whether Defendants have engaged in falsifying medical records, Racketeer Influenced and Corrupt Organizations Act (“RICO”) violations, RICO conspiracy, assault, battery, and/or breaches of fiduciary against Ms. Grant” as well as other “potential causes of action.”

In addition to treating employees and talent of WWE, Colker has a number of high-profile clients including Andre Agassi, Bradley Cooper, Jeremy Piven (who was named in the #MeToo movement by several women for sexual misconduct), and Shaq. Colker appeared on Shaq's reality show, "Shaq's Big Challenge" on ABC in 2007.

At the end of May, Grant paused her lawsuit as the DOJ continued its investigation into McMahon. In August 2023, a federal grand jury subpoenaed McMahon. Prior to the pause on the lawsuit, both McMahon and Laurinaitis sought arbitration.

On Tuesday afternoon, a spokesperson for McMahon released a statement to Wrestlenomics:

“Ms. Grant’s petition for pre-action discovery against Dr. Colker is a direct violation of the court-ordered stay, and nothing more than an attempt to generate publicity on her false allegations and to harass people connected to Mr. McMahon, who is being sued by Ms. Grant in a separate matter."

“The facts are that Ms. Grant told Mr. McMahon she was fatigued and asked him to recommend a doctor,” the spokesperson said. “Ms. Grant called Dr. Colker and became a patient of his. Her statement in the filing is inconsistent with her prior remarks. Ms. Grant never had anything but good things to say about the doctor when speaking to Mr. McMahon and others about him.”

As of this writing, there has not been a statement for Dr. Colker or Peak Wellness.

We are approaching one year since the federal grand jury subpoena. One of WWE's biggest pay-per-views, SummerSlam, will take place on August 3 in Cleveland, Ohio. The initial lawsuit filed by Grant's team was just days before Royal Rumble. With the pause on the lawsuit, it would seem that the DOJ could potentailly hand down an indictment any day now.
